In 2023, I experienced wrongful termination by a well-known division of the edtech company Digital Promise, named Digital Equity, formerly known as Verizon Innovative Learning Schools, after raising concerns about toxic leadership in my workplace. It began when an external partner made claims against me and an internal mid-level leader implied that their role carried more value than mine. Over time, it became evident that these sentiments were shared by senior leadership, as I was repeatedly forced to appease external partners who were underperforming in their own roles. Rather than addressing the partner’s lack of performance or helping them grow in their character and skill set, I was made to appear as the problem.
As I escalated my concerns and highlighted the gaps in leadership, it became clear that many of the senior leaders themselves lacked the skills to coach and develop those they were responsible for leading. Instead of investigating the issues I raised, senior leadership painted me as insubordinate and unwilling to cooperate. They even accused me of making social media posts that “could be viewed as malicious, obscene, threatening, or intimidating.” No evidence of these posts was ever shown, and anyone who knows me understands that my online presence is deeply rooted in edification and encouragement—that’s simply who I am. When people are on a mission to get rid of you, they will fabricate anything.
This experience was not only frustrating but also eye-opening—it highlighted how often organizations prioritize protecting the status quo over addressing critical problems.
Unfortunately, my story is not unique. According to the EEOC, retaliation claims account for 56% of workplace discrimination charges, underscoring how pervasive this issue is. Wrongful termination is often a symptom of deeper organizational dysfunction, and without intentional leadership, these situations will continue to arise. This blog explores how leaders can avoid such pitfalls and build a culture of fairness, transparency, and accountability.
The Cost of Negligence
Wrongful termination isn’t just unfair—it carries significant consequences for organizations:
- Financial Impact: Legal fees, settlements, and potential lawsuits can drain resources.
- Team Morale: Employees lose trust in leadership, resulting in lower engagement and higher turnover.
- Talent Loss: Wrongfully terminated employees are often invested, high-potential individuals whose loss can weaken the organization.
- Reputation Damage: Stories of wrongful termination spread quickly, especially in the age of social media, tarnishing the organization’s public image.
The cost of negligence is far greater than taking the time to address issues with fairness and integrity.
Common Pitfalls That Lead to Wrongful Termination
- Failure to Investigate Thoroughly
Leadership often relies on assumptions or biased reports without conducting a proper investigation. This negligence undermines trust and results in unfair decisions. - Silencing Whistleblowers
Employees who raise concerns about toxic practices or poor leadership are frequently labeled as troublemakers rather than being seen as advocates for improvement. - Protecting Toxic Leadership
Organizations often prioritize the reputation of senior leaders or external partners over addressing legitimate issues, perpetuating a culture of toxicity. - Bias in Decision-Making
Decisions are sometimes influenced by personal biases or pressure to maintain relationships, rather than being rooted in fairness and facts.
Actionable Steps for Leaders
To foster a culture of fairness and avoid wrongful terminations, leaders must take intentional and proactive steps:
- Encourage Transparency
Create systems that allow employees to raise concerns without fear of retaliation. Ensure every complaint is met with a documented, unbiased investigation process. - Address the Root Cause
Identify whether the real issue lies with the employee, leadership, or organizational culture. Avoid scapegoating employees who highlight systemic problems. - Seek Objectivity
Engage HR professionals or external consultants to conduct fair investigations. Objectivity ensures decisions are based on facts, not assumptions or favoritism. - Protect Whistleblowers
Establish and enforce policies that safeguard employees who bring concerns forward. Encouraging accountability creates an environment of trust and openness. - Invest in Leadership Development
Equip leaders with the tools to handle conflict, coach effectively, and foster inclusivity. Strong leadership minimizes the chances of negligence and workplace toxicity.
Recognizing Assets Within Your Organization
It’s easy to label employees who speak up as problems, but in reality, these individuals are often your greatest assets. Employees who raise concerns about toxic practices are typically invested in the organization’s success and are advocating for change. Silencing these voices not only prevents growth but also creates a culture where employees are afraid to share ideas or address issues.
Consider this: 62% of employees believe their complaints are ignored or lead to retaliation. By failing to listen to these voices, organizations miss out on valuable insights, innovation, and opportunities for improvement.
Conclusion: A Call to Action
Wrongful termination is a preventable issue, but it requires intentional leadership rooted in fairness, transparency, and accountability. Leaders must prioritize listening, investigating, and addressing concerns constructively, rather than silencing those who challenge the status quo.
As a leader, ask yourself:
- Are you fostering a culture where employees feel valued and heard?
- Are you addressing the root causes of conflict rather than scapegoating individuals?
- Are you equipping your team with the tools to thrive?
Creating a workplace where fairness thrives isn’t just the right thing to do—it’s essential for long-term organizational success. Let’s commit to building environments where employees can grow, innovate, and collaborate without fear.
